Can Delay Be Condoned While Filing an Appeal Before the NCDRC?

The State Consumer Commission can issue an adverse order against any consumer, builder, insurance company, bank, hospital, manufacturer or service provider. That party may want to appeal the order to the National Consumer Disputes Redressal Commission (“NCDRC”).The problem arises when the time period to file such an appeal has already passed.

Is there still time to file an appeal? Yes, but the late appeal will have to satisfy the NCDRC with a properly drafted application for condonation of delay in an NCDRC appeal. The party filing the late appeal will have to demonstrate sufficient cause as to why they couldn’t file the appeal on time.

Under Section 51 of the Consumer Protection Act, 2019 there is a general timeframe of 30 days to file an appeal before the National Commission against an order passed by a State Consumer Commission that is eligible to be appealed. The NCDRC can allow an appeal to be filed after the expiration of the 30 days if it is satisfied that the appellant had sufficient cause which prevented it from filing on time.

What Does Condonation of Delay in an NCDRC Appeal Mean?

When you seek condonation of delay, you are essentially praying for the NCDRC to excuse your delay in filing the appeal. Condonation of delay does not extend limitation and also does not assure that your appeal will be accepted.

Reasons for the delay need to be presented by the applicant in an application supported by an affidavit. The Commission looks into whether the reasons advanced constitute sufficient cause and whether the appellant has acted in good faith and with due diligence.

The NCDRC may decide your application for condonation of delay first even if your main appeal is very strong. Only if your delay is condoned will the substantive grounds for interfering with the order of the State Commission be looked into.

Why Should Every Material Period of Delay Be Explained?

A delay- condonation application must contain a plausible and continuous chronology from the date of expiry of limitation up until the date of filing of appeal.

If you received the order in January, consulted your lawyer in February and eventually filed your appeal in June. You would have to cover the delay from January to February as well as from February to June.

The gaps in the timeline shouldn't be left unexplained. Advocate BK Singh will be able to go through the entire chronology and point out if there are medical documents, certified-copy judgements, pleadings, internal memos or anything else to corroborate the explanation provided.

Which Reasons May Support Condonation of Delay?

Critical illness, hospitalization, late conveyance of the order, unavoidable private affairs or an evidenced administrative hurdle could be reasons in support of the petition. The company could also justify the delay in getting their internal approvals however simple routing of the order within the administrative departments may not be condoned every time.

The reason for delay should show that it was not intentional and also was not caused by utterly careless behavior. After the hindrance ceased to exist the petitioner should also prove that he took whatever steps could be reasonably expected of him and did not indulge in any further undue delay.

Prior to meeting with Advocate BK Singh, we advise our clients to gather:

  • Copy of the Order of the State Commission

  • Evidence of the date of receipt of the order.

  • Application(with details of delivery) and Order Certified-copy.

  • Medical records/Hospitalization Proofs if any.

  • Emails and correspondence.

  • Company approvals if any.

  • Date wise timeline of events.

  • Copies of documents to be used for filing the appeal.

Can a Strong Appeal Automatically Cure the Filing Delay?

NO. A meritorious case is not a ground to override the limitation objection as such.

Memorandum of appeal and delay-condonation application have different purposes. The appeal memo tells the NCDRC why the order of the State Commission’ should be set aside/ varied. The delay application tells NCDRC why the appeal was not filed in time. Both documents need to be drafted meticulously. An appellant cannot expect NCDRC to condone delay merely because a large amount is involved or because the State Commission’s order is plainly wrong.

Better to discuss your matter with Advocate BK Singh at the beginning stage itself. He will be able to advise you if the proposed appeal involves sustainable legal points and whether adequate material is available for condonation.

Is a Statutory Deposit Required Before the Appeal Is Entertained?

Where appellant has been ordered by the State Consumer Commission to pay an amount, section 51 states that 50% amount has to be deposited before entertaining appeal.

Condonation of delay application and deposit amount are two different legal technicalities. If we only file a condonation application, it may lead to more objections when they see that you have not considered the statutory condition of deposit.

You have to see the actual requirement from the wording of impugned order, nature of appeal & relief prayed for. BK Singh can look into these aspects before finalising papers.

Yes. Delayed appeal can be filed with an application praying condonation of delay. Applicant has to prove that there was sufficient cause for not filing the appeal within the stipulated time.

3. Is condonation of delay automatically granted?

No. Grant of Condonation is at the discretion of the Commission. The Commission would look into the explanation given by the applicant, documentary evidence, period of delay and overall conduct of the applicant.
